TERMS & CONDITONS

Payment Terms:

The goods will remain the property of FOAM & LEATHER until FULL payment is received. Payment terms are cash or mobile pay (BOV/REVOLUT) upon delivery or bank transfer before the delivery date to confirm payment. CHEQUES AND LPO`S ARE NOT ACCEPTED.

PRICES CHANGES & FUTURE PRICELISTS:

Due to constant price fluctuations in regards with shipping costs, raw material costs & covid related inflations we do not have control on price changes on our products. Thus this sometimes leads to having some items at the store with new price changes while the website not being updated at the same time as we need to wait on our web developer to make changes. This might lead to the rare occasion that a product seen on the website to be different from the actual price in store. It is best to call or send an email to make sure 100% the item your are interested in is using the updated corresponding price as to have no misunderstandings with our beloved clients. PRICES SHOWN ON THE WEBSITE ARE NOT FINAL & SUBJECT TO CHANGE ACCORDINGLY - ONLY IN STORE PRICELISTS ARE UPDATED AND VALID.

Delivery Terms:

We offer free delivery to all locations in Malta & Gozo for large bulky items such as mattresses (non vacuum packed models) & furniture to ground floor level, delivery for smaller items such as pillows, bed linen etc is not offered but depending on the quantity needed and location sometimes exceptions are  made - in that case it is best to call or send an email to check availability. If client has an address for delivery with an apartment/house more than ground floor level a lifter service may be booked by the client at their own cost or we may deliver to the ground floor level only for free. Only the first delivery is free of charge, any reason due to mistake by client (ie: wrong size or product ordered, client not present for appointment after date & time agreed) to replace the product purchased via delivery by us is subject to an extra charge accordingly. If a mistake was made from our end (ie: wrong size, colour, product or damaged/defective goods) will be replaced and redelivered free of charge.

Collection & Disposal of Old Mattresses:

At the present moment we are not permitted to collect & dispose of old mattress due to health concerns regarding Covid-19 & other diseases. Reason being is due to old mattresses being a carrier for bacteria and may cross contaminate other new sealed mattress in our delivery van thus spreading the risk of disease in other clients households where vulnerable people may be present making it a health hazard for our clients and employees. Until further notice only your local council may collect & dispose of your old mattress - FREE OF CHARGE

RETURNS OF SMALL ITEMS:

 

NO REFUNDS

Most small items that are kept in there original packaging may be returned and replaced with another product of the same price (or of a higher price - in this case the difference must be payed by the client) or a credit note may be issued in return for the product upon showing of original Receipt.

Items such as bed sheets, duvet covers, protectors and other similar products which are packed in a similar single-use plastic packaging once opened and washed in the washing machine unless a factory defect is present under no circumstance will be replaced for a new one nor will a credit note be issued.

 

It is the clients responsibility to make sure the measurements on the product is correct and

compatible with the bed/mattress they own before opening - If the items are opened and the client bought the incorrect size the product will not be replaced nor will a credit note be issued.

We offer a sleep trial for all Pillow/s which is valid for a period of 3 Days only - if the comfort of the pillow/s is not to the clients liking within this trial period the client is eligible to replace the pillow/s for a different one of the same price (or of a higher price - in this case the difference must be payed by the client). Pillow/s returned after the trial period will not be accepted/replaced nor will a credit note be issued. Pillow/s returned within the trail period which have been soiled/damaged/stained etc it will not be accepted/replaced nor will a credit note be issued.

RETURNS OF VACUUM PACKED ITEMS:

NO REFUNDS

Some of the products we offer come in a vacuum packed single seal plastic packaging (toppers, mattress etc) It is the clients responsibility to make sure the measurements on the product is correct and

compatible with the bed/mattress they own before opening.

If the items are opened and the client bought the incorrect size the product will NOT be replaced with another size nor will a credit note be issued.

If item returned has been soiled/damaged/stained etc it will not be accepted/replaced nor will a credit note be issued.

Returns of Mattress (Non-Vacuum Packed Models):

We do not offer a sleep trial on our mattresses for hygiene related purposes - mattresses will not be replaced for a different model for any reason related to comfort unless a factory defect is present & covered by products warranty nor will a credit note be issued. However our clients may ease their minds as we have over 40 Years of experience in the mattress & bedding field and are very careful to which mattress model is sold too according to each individual specific needs thus avoiding the rare occasion where a client is unhappy with their choice - however even if in the event the client is not happy with the comfort of their purchase we still offer alternative solutions to help remedy the issue without the need to replace the mattress.

 

If the wrong size was purchased by the client before the mattress has been used (wrong size must be reported within 48 hours of delivery or the mattress will not be replaced nor will a credit note be issued) We can replace it for the correct size at an extra charge as per the DELIVERY TERMS section in this terms & condition page. If the mattresses original packaging has be opened & disposed, an charge may be imposed onto the client to cover the cost for repackaging the mattress. If mattress returned has been soiled/damaged/stained etc it will not be accepted/replaced nor will a credit note be issued.
